Terms of Service

In short: Handl’d is an independent car buying service. We research, compare and negotiate on your behalf for a flat fee agreed upfront. We don’t sell cars, arrange finance, or take any fee from dealerships — and we don’t guarantee a specific price or outcome. You make the final decision and sign contracts directly with the dealership. Section 2 below sets out our disclosure as a motor vehicle broker under NSW law.
1. Who we are
Handl’d is an independent car buying service operating in Sydney and New South Wales, Australia. Throughout these terms, “Handl’d”, “we”, “us” and “our” refer to the service; “you” and “your” refer to the person engaging Handl’d.
Handl’d is not a dealership, retailer, wholesaler, or finance provider, and holds no motor dealer’s licence. We don’t sell vehicles, hold vehicle stock, or arrange finance on your behalf. Our role is to research, compare and negotiate on your behalf as your representative in the buying process. See section 2 for our specific disclosure under NSW motor vehicle broker law.
2. Broker disclosure (required under NSW law)
Under section 103 of the Motor Dealers and Repairers Act 2013 (NSW), a person who negotiates on behalf of a buyer and advises on the purchase of motor vehicles — without acting as a retailer, wholesaler or financier — is a “motor vehicle broker” for the purposes of that Act, and must disclose certain information to clients before providing services. In compliance with that requirement, Handl’d discloses the following:
- Handl’d has no financial or other business relationship with any dealership or supplier of a motor vehicle in relation to services we provide.
- Handl’d does not receive any fee, commission or other consideration from a dealership or supplier arising from the services we provide. The only payment we receive for an engagement is the flat fee agreed directly with you, as described in section 4 below.
This disclosure applies to every engagement with Handl’d and is made before any chargeable work begins.
3. What the service includes
Depending on the engagement agreed with you, Handl’d may:
- Research vehicles, market pricing and comparable sales relevant to your requirements
- Communicate with dealerships on your behalf
- Negotiate price and deal structure on your behalf
- Provide a Deal Score or written assessment of a quote you’ve already received
- Present options and recommendations for you to decide on
The specific scope of work is agreed with you before you’re charged, typically following an initial consultation.
4. What the service does not include
Handl’d does not sign contracts, arrange finance, or hold funds on your behalf. Once you decide to proceed with a vehicle, you deal directly with the dealership (and, if applicable, your own finance provider) to finalise the purchase, contract, trade-in and delivery. Handl’d is not a party to that contract and holds no legal or financial responsibility for its terms.
We do not provide financial, credit, insurance or legal advice. If you need advice in any of these areas, we recommend speaking with a licensed professional.
5. Fees and payment
Handl’d operates on a flat-fee basis. The fee for your engagement is agreed with you upfront, before any chargeable work begins, and does not change based on the outcome of the negotiation. We don’t receive commissions, referral fees, or other incentives from dealerships, financiers, or any third party in connection with your purchase.
Payment terms (amount, timing and method) will be confirmed with you directly as part of your engagement.
6. No guarantee of price or outcome
We work to help you avoid overpaying and to negotiate the best outcome we reasonably can, based on market context, comparable sales, and our experience. However, we don’t guarantee a specific price, discount, or outcome on any vehicle purchase. Dealership pricing, stock availability, and willingness to negotiate vary and are outside our control.
The Deal Score tool available on our website provides an illustrative, general-guidance assessment based on comparable reference data. It is not a live dealer feed or formal valuation, and shouldn’t be relied on as the sole basis for a purchase decision.
7. Your responsibilities
To help us do this properly, you agree to give us accurate and complete information relevant to your requirements and budget, and to make your own final decision on any vehicle, price, or contract presented to you. You’re responsible for reviewing and understanding any contract, finance agreement, or other document before signing it — Handl’d is not a party to those agreements and cannot review them on your behalf as legal advice.
8. Limitation of liability
To the maximum extent permitted by law, Handl’d’s liability for any loss or damage arising from or connected to the service is limited to the fee you paid for the relevant engagement. We are not liable for indirect, consequential loss, or loss arising from decisions made by you, a dealership, or a third-party financier.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
9. Website use
The content on this website, including the Deal Score tool, guides, and written content, is provided for general informational purposes and reflects general car-buying practices in the Australian market. It should not be treated as personalised financial, legal, or valuation advice for your specific situation.
10. Ending the engagement
Either party may end an engagement at any time by notifying the other. If work has already been completed or is in progress at that point, fees may still apply for work already performed, as agreed at the time of engagement.
11. Governing law
These terms are governed by the laws of New South Wales, Australia, and any dispute arising from them will be subject to the jurisdiction of the courts of New South Wales.
12. Changes to these terms
We may update these terms from time to time as the business evolves. The “last updated” date above will always reflect the most recent version. Continuing to use the service after an update means you accept the revised terms.
